Illegal Construction Near Narsingi Lake: Appeal Filed Against TGRERA’s Order
Hyderabad, June 17 (Same Day): An appeal has been filed before the Telangana Real Estate Appellate Tribunal challenging the recent order of the Telangana State Real Estate Regulatory Authority (TGRERA), which allegedly favoured Phoenix Global Spaces Pvt. Ltd. and Sumadhura Constructions Pvt. Ltd. in a contentious real estate project located in a prohibited zone near Narsingi Lake-2 (HMDA Lake ID 2939).
The appeal, sent via registered post on June 16, 2025, seeks to overturn what the appellant describes as an “erroneous and arbitrary order” that failed to consider key environmental and legal violations. The disputed constructions pertain to residential projects — including ‘Triton’ and developments under the Sumadhura brand — on land in Survey Nos. 272(P) and 273(P) of Puppalaguda village in Gandipet mandal, which falls under the prohibited area of an HMDA-listed water body.
The appellant, Dr. Lubna Sarwath, has also submitted a request for waiver of the mandatory ₹5,000 tribunal fee, citing public interest. The waiver requested notes that the fee had already been paid in Case No. A.R. 07/2025, filed earlier on the same matter.
“It is not just about construction irregularities — it is about upholding the rights of allottees and the ecological protection of a water body recognised by HMDA,” Dr. Sarwath stated in the appeal.
Key Grounds in Appeal...
Among the grounds cited in the appeal is a clause in the Telangana State Industrial Infrastructure Corporation (TSIIC) permit, which mandates automatic cancellation of building permits in the event of legal disputes concerning the land. The appellant argues that TGRERA overlooked this clause, despite the existence of ongoing litigation.
Further, the appeal refers to alleged violations under the Real Estate (Regulation and Development) Act, 2016, especially in relation to Section 4(g) and Section 4(l), which pertain to the promoter’s obligations to disclose legal title and encumbrance status.
The appellant claims that these mandatory disclosures were either misrepresented or not adequately verified by TGRERA while granting approval, thereby compromising transparency and the rights of the allottees. The matter is expected to be taken up by the Appellate Tribunal in due course.
